These Terms of Service ("Terms") govern your use of SearchSense's AI-powered search solution for WooCommerce stores, operated by Testica Iga Małłek. By using our service, you agree to be bound by these Terms.

Our Philosophy: We believe in good faith business relationships. These terms are enforced with common sense and communication. We're a small business serving small businesses, and we prefer working together to resolve issues over legal enforcement.

1. Acceptance of Terms

By accessing or using SearchSense, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our service.

2. Service Description

SearchSense provides:

• AI-powered search functionality for WooCommerce stores
• Natural language processing for product discovery
• Search analytics and insights
• API access for integration with your store
• WordPress plugin for easy implementation

2.1 Service Plans

Our plans include specific product catalog limits (clearly shown at signup) with unlimited searches and API calls for normal business operations. All usage is subject to our Fair Use Policy.

3. Account Registration

To use SearchSense, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Have the legal authority to enter into these Terms

4. Acceptable Use

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Reverse engineer or attempt to extract the source code
• Use the service to transmit malware or harmful code
• Violate any applicable laws or regulations
• Resell or redistribute the service without permission
• Use automated systems to scrape or harvest data
• Implement API calls without reasonable caching (minimum 60 seconds)
• Use the service to stress-test your systems without prior approval
• Share API keys or make them publicly accessible

5. Fair Use Policy

5.1 Unlimited Usage

We provide unlimited searches and API calls for legitimate business use. This includes:

• Customer searches on your website
• Admin dashboard usage
• Normal API integrations
• Reasonable testing and development
• Traffic from marketing campaigns and sales

5.2 Abnormal Usage Patterns

We may temporarily apply protective measures if we detect:

• Automated requests exceeding 100 requests per second from a single source
• Patterns consistent with data scraping or harvesting
• Traffic that appears to be a security attack
• Requests that degrade service quality for other customers
• Usage patterns inconsistent with normal e-commerce operations

5.3 Our Response to Issues

If we detect abnormal usage:

1. Automatic rate limiting may apply temporarily
2. We'll contact you to understand the situation
3. We'll work together to find a solution
4. Only repeated, intentional abuse leads to account suspension

5.4 Security Events

If your store is under attack (DDoS, hacking attempts, etc.):

• We'll implement protective measures to maintain service
• This may include temporary rate limits or geographic filtering
• We'll work with you throughout the incident
• You will never be penalized for being a victim of attacks

6. Subscription and Payment

6.1 Billing

• Monthly subscription plans available
• You authorize us to charge your payment method automatically
• Founders pricing: Early customers receive special pricing that remains fixed for the lifetime of their subscription
• Prices for new subscriptions may change at any time
• Existing customers receive 60 days notice before any price increase
• You may upgrade or downgrade your plan at any time

6.2 Refunds

We offer a 30-day money-back guarantee for first-time subscribers only. After this period, refunds are provided at our discretion. No refunds are provided for partial months or unused services.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You'll retain access until the end of your paid period.

6.4 Free Trials

Free trials may be offered at our discretion. No payment method required during trial. Trial features may be limited. Only one trial per company.

7. Intellectual Property

7.1 Our Property

SearchSense and its original content, features, and functionality are owned by Testica Iga Małłek and are protected by international copyright and other intellectual property laws.

7.2 Your Content

You retain ownership of your product data and content. By using our service, you grant us a license to use, process, and display your content solely for providing the service.

8. Privacy and Data Protection

Your use of SearchSense is also governed by our Privacy Policy. We are committed to protecting your data and complying with applicable data protection laws.

9. Service Level and Support

9.1 Availability

We target 99.5% uptime, though this is a goal, not a guarantee. Uptime calculation excludes scheduled maintenance (communicated 48 hours in advance when possible). We do not provide service level agreements (SLAs), service credits, or refunds for any downtime.

9.2 Support

Email support is provided with best effort response within 2 business days. Priority support may be available on higher tier plans.

9.3 Service Protection

We implement automatic protections against abuse and attacks. This may include rate limiting, CAPTCHA, or temporary restrictions. Legitimate users are rarely affected. Contact support if you encounter false positives.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, SearchSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you to SearchSense in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Testica Iga Małłek (operating as SearchSense), its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

13. Termination

13.1 Response to Violations

Our approach depends on the nature of the issue:

• Technical issues: We'll help you fix them
• Unintentional overuse: We'll discuss solutions
• First-time violations: Warning and guidance
• Repeated violations: Temporary suspension
• Intentional abuse or illegal activity: Immediate termination

13.2 Never Penalized For

• Being targeted by attacks or DDoS
• Legitimate traffic spikes from sales or marketing
• Normal business growth
• Good faith testing and development

13.3 Non-Payment

For payment failures, we provide a 7-day grace period before suspension. We'll attempt to contact you before taking any action.

13.4 Data Export

Upon termination, you have 30 days to export your data. This includes product catalogs, configuration, and analytics. Data will be permanently deleted 60 days after termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Toruń, Poland.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the service. Your continued use after changes constitutes acceptance of the modified Terms.
